Terms and Conditions

Upon the viewing and using the site, You hereby agree to this Terms and Conditions Agreement, heretofore referred to interchangeably as the “Terms”, "Terms and Conditions", and "Terms of Use." This Agreement is entered into by and between Toxic HD Entertainment, heretofore referred to interchangeably as “Toxic HD”, “Service,” or “We,” and You, heretofore referred to interchangeably as "You", “User”, or “Client.”

Toxic HD claims the copyrights for all material produced or created by Toxic HD. These copyrighted materials may include Clients' represented and/or copyrighted work, and/or Trade Marks. When such works do include original copyrighted work, and/or trade Marks of the Client, Toxic HD may reproduce and display them on ToxicHD.com in order to represent the Client, but will NOT use them for commercial use for any other Client.

You may not use Toxic HD Copyrighted work without explicit written permission accompanied by a valid signature. If work by Toxic HD is used without the preceding conditions, legal action will be taken as necessary.

At any time before or up to 30 days after the initial agreement is created between Toxic HD and the client, clients have the option to cancel or change the provided project or work, upon which new terms will be written specifically for the client at which point the client has 48 hours to remove and destroy copyrighted work by Toxic HD. The time period in which a project or work can be canceled or changed may be negotiated at the time of the initial agreement. If this is not negotiated at that time, then the time period in which a project or work can be canceled or changed will not exceed 30 days from the initial agreement.

These Terms constitute the entire agreement between the User and the Service and supersedes all previous written or oral agreements.
If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect.

Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such states, our liability shall be limited to the greatest extent permitted by law.

The User is bound by any changes to this Privacy Policy when he or she enters in an agreement with Toxic HD after those changes have been posted.

Toxic HD reserves the right to change, amend, modify, or alter this Privacy Policy at anytime without warning or notification.
